END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Double L Tech LLC, the developer of the Clean Stop ("App"), which allows you to use the App for finding clean restrooms and interacting with restroom owners.

By using this App, you agree to be bound by the terms and conditions of this Agreement.

1. LICENSE GRANT

Double L Tech LLC grants you a non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for personal, non-commercial use, subject to the terms of this Agreement.

2. LOCATION DATA USAGE

To provide the services offered by the App, we collect and use your location data as follows:

  • Finding Restroom Locations: The App uses your location data to show the nearest clean restroom locations that have been marked by restroom owners. The App uses this location data to help you navigate to the nearest available restrooms.

  • Owner Location Data: If you are a restroom owner, the App collects your location data to drop a pin showing your restroom's location, custom advertisement, and the time of the last cleaning. Other users will be able to view your location and receive driving directions to your restroom.

  • Navigation Directions: We use Apple Maps to provide you with directions from your current location to a restroom location. By using the App, you agree to allow the App to access and share your location data with Apple Maps to provide accurate driving directions.

  • Opt-In Location Services: The App only collects location data if you grant permission via the device’s location settings. You can disable location services at any time by adjusting your device settings. However, disabling location services may prevent you from fully using the App’s features.

3. USER-GENERATED CONTENT

You may have the ability to submit content to the App, such as advertisements or restroom status updates. By submitting content, you grant Double L Tech LLC a worldwide, royalty-free license to use, display, and distribute such content within the App, including in connection with user features like location pins.

  • Responsibility for Content: You are solely responsible for the content you submit, and you must ensure that it complies with all applicable laws. Double L Tech LLC reserves the right to remove any content that violates our content guidelines.

  • Prohibited Content: You may not submit content that is defamatory, illegal, offensive, or violates the rights of others. Double L Tech LLC has the right to remove content that we deem inappropriate.

4. PRIVACY AND DATA COLLECTION

We value your privacy. The App does not collect unnecessary personal information about you. Specifically, we do not require you to provide personal details like your name, email address, or phone number.

  • Location Data: As mentioned above, the App uses location data to provide its core services, including finding the nearest clean restroom and providing driving directions via Apple Maps. As well as logging your GPS coordinates and text you provide in the “advertisement” box to insure that you are complying with the details of the “user generated content” and “user conduct & harmful content” sections of this agreement.

  • No Sale of Data: Double L Tech LLC does not sell your personal or location data to third parties. We do not share, sell, or monetize any information that could be used to personally identify you, except as required by law or with service providers necessary to operate the App (e.g., Apple Maps for navigation).

  • Third-Party Services: The App uses third-party services like Apple Maps for navigation. These services may collect data from you as outlined in their respective privacy policies. By using the App, you acknowledge and agree to the privacy policies of Apple Maps or any other third-party services you interact with via the App.

5. User Conduct & Harmful Content

  • Harmful Content: You agree not to post, share, or use the App for any content that:

    • Promotes harm or illegal activity.

    • Contains obscene, offensive, or discriminatory material.

    • Violates the rights of others or promotes violence, hatred, or discrimination.

If a restroom owner is found to violate these terms, including inappropriate or harmful content in their advertisements or actions, Double L Tech LLC reserves the right to suspend or terminate their account and remove any harmful content.

  • Content Moderation: We reserve the right to monitor, review, and remove any content that violates our guidelines. Restroom owners who repeatedly violate the App’s terms may be banned from using the App permanently.

6. IN-APP PURCHASES AND SUBSCRIPTIONS

The App may offer in-app purchases or subscriptions, including access to premium features. If you choose to make an in-app purchase or subscribe to a service, the following terms apply:

  • Pricing and Payment: The App uses Apple's in-app purchase system, and all payments are processed via your Apple ID account. Pricing for any subscriptions or purchases will be clearly displayed in the App.

  • Subscription Renewal: Subscriptions may auto-renew unless you cancel them at least 24 hours before the end of the current period. You can manage or cancel your subscription through the App Store settings.

  • Refunds: Refunds for in-app purchases and subscriptions are processed via Apple's App Store refund process. Double L Tech LLC does not handle refunds directly.

7. LIMITATIONS AND DISCLAIMERS

  • No Warranty: The App is provided "as-is" and without warranty of any kind. Neither Clean Stop nor Apple guarantee that the App will be error-free, uninterrupted, or meet your specific needs.

  • Limitation of Liability: To the fullest extent permitted by law, neither Double L Tech LLC nor Apple shall be liable for any indirect, incidental, special, or consequential damages arising from the use of the App, including but not limited to the accuracy of location data, driving directions, or user-generated content.

  • To the fullest extent permitted by law, Double L Tech LLC and Apple are not liable for any damages, losses, or injuries resulting from the use of Clean Stop.

  • You agree to indemnify and hold harmless Double L Tech LLC and Apple, as well as their affiliates, from any claims, losses, or damages arising out of your use of Clean Stop.

8. APP STORE COMPLIANCE

You acknowledge and agree that this Agreement complies with the guidelines and policies set forth by Apple for apps distributed through the App Store. Including the terms for in-app purchases, App Store Review Guidelines, legal requirements, technical requirements, location services, and data privacy.

  • Apple’s Role: Apple is not responsible for the operation of the App or any of its content. Any complaints or issues with the App should be directed to Double L Tech LLC. Apple does reserve the right to remove the app from the store if it violates their guidelines.

9. TERMINATION

Double L Tech LLC may suspend or terminate your access to the App at any time, for any reason, without notice. If you wish to terminate this Agreement, you may stop using the App at any time.

10. Changes to the Agreement

Double L Tech LLC reserves the right to modify or update the terms of this Agreement at any time. Any changes to this Agreement will be communicated to you through the App or other appropriate channels. Your continued use of the App after any changes constitutes your acceptance of the modified terms.

11. GOVERNING LAW

Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the state of [Arkansas/United States of America], without regard to its conflict of law principles.
Any dispute arising from or related to this Agreement shall be subject to binding arbitration in the state of [Arkansas], and users agree to resolve any disputes individually and not as part of a class action or representative action. The arbitration shall be conducted in accordance with the rules of [American Arbitration Association (AAA)] or another mutually agreed-upon arbitration service.
Notwithstanding the foregoing, nothing in this Agreement will be deemed to waive or limit either party's rights to seek remedies in a small claims court or other court of competent jurisdiction in the event of claims related to intellectual property infringement or violations of Apple’s terms.

12. Compliance with Apple’s App Store Review Guidelines
You agree to comply with all Apple App Store Review Guidelines, the Apple Developer Program License Agreement, and any other terms and policies required by Apple for apps distributed through the App Store. You also agree to comply with all applicable laws, including export control laws and regulations, and ensure that the App does not violate any legal restrictions that could affect its distribution or use in different jurisdictions.

13. Apple’s Role in Payments and In-App Purchases
You acknowledge and agree that Apple is solely responsible for the processing of all in-app purchases and subscriptions made through the App Store, including any billing or payment disputes. All transactions are handled through Apple’s App Store platform, and refunds for in-app purchases or subscriptions must be requested directly through Apple. Double L Tech LLC is not responsible for any payment disputes or refunds related to in-app purchases.

SUBSCRIPTION AGREEMENT

Effective Date: [11-26-2024]

This Subscription Agreement ("Agreement") governs the terms of your subscription to the premium features of Clean Stop ("App"). By subscribing, you agree to the terms of this Agreement and acknowledge that you have read and understood the terms related to automatic renewal, cancellation, and refunds.

1. Subscription Terms

  • Price: The subscription fee is $7.99 per month.

  • Billing: Your subscription will be automatically billed every month, starting from the date of purchase, unless you cancel your subscription prior to the next billing cycle. The billing is processed through Apple's in-app purchase system and will be charged to your Apple ID account.

2. Content and Service Access

As a subscriber, you will have access to the following premium features:

  • Pin Annotation: You will be able to drop a pin annotation at your current location, marking your restroom as clean with the time of cleaning.

  • Custom Advertisement: You can place a custom advertisement in the App, which will be visible to users who view your pin annotation.

  • Location Visibility: Your restroom location will be visible to users who can view your pin, and you will have the ability to update your cleaning time and advertisement at any time.

3. Auto-Renewing Subscription

  • Automatic Renewal: Your subscription will automatically renew every month unless you cancel it at least 24 hours before the end of the current subscription period.

  • Cancellation: You may cancel your subscription at any time via your device settings under "Subscriptions" in the Apple ID settings. Please note that cancellations are effective only at the end of the current billing cycle, and you will continue to have access to the premium features until the subscription period ends.

How to Cancel:

  1. Open the Settings app on your device.

  2. Tap [your name] at the top of the screen.

  3. Select Subscriptions.

  4. Choose Clean Stop.

  5. Tap Cancel Subscription and follow the prompts.

4. Refund Policy

  • No Refunds: Except where required by law, there are no refunds for any subscription fees, including if you decide to stop using the App before the end of the current billing cycle. Once your payment is processed, it is non-refundable.

  • App Malfunction: If the App does not function as advertised, and you are unable to access the premium features you’ve paid for, please contact us at contact@cleanstopapp.com so we can attempt to resolve the issue. If the issue cannot be resolved, and we determine that you were not able to access the service through no fault of your own, we may issue a refund at our sole discretion, but this is not guaranteed.

  • It’s Your Responsibility to Cancel: You are responsible for managing your subscription. If you no longer wish to be charged, you must cancel your subscription before the next billing cycle. We are not responsible for any charges incurred if you do not cancel the subscription in time.

5. Terms of Use and Privacy Policy

  • Compliance with Apple's Guidelines: This subscription is governed by the terms outlined in Apple's App Store guidelines, and all payments will be processed through your Apple ID account. For more information on how Apple handles payments and subscriptions, please refer to Apple's terms and conditions.

  • Privacy: We respect your privacy and are committed to protecting your personal information. For more information about how we collect and use your data, please review our Privacy Policy.

6. Termination

We may suspend or terminate your subscription if you violate this Agreement or our Terms of Service. If we terminate your subscription for any reason, you will not be entitled to a refund, but you will continue to have access to premium features until the end of the current billing cycle.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Double L Tech LLC shall not be liable for any damages resulting from the use or inability to use the App, including but not limited to any loss of data, loss of income, or other indirect or consequential damages arising from the subscription.

8. Changes to This Agreement

We reserve the right to modify or update the terms of this Agreement at any time. If changes are made, we will provide notice via the App or other appropriate means. Your continued use of the subscription after any changes constitutes your acceptance of the new terms.

By subscribing to Clean Stop, you acknowledge and agree to the terms of this Subscription Agreement.

Mapping API License - Apple Maps

By using Clean Stop (the "App"), you acknowledge and agree to the following terms regarding the use of Apple Maps and its related services:

1. Apple Maps Terms of Use

  • Apple Maps is provided by Apple Inc. and its affiliates ("Apple").

  • By using the App, you agree to comply with all applicable terms and conditions of the Apple Maps Terms of Service, which are available at Apple Maps Terms of Service URL.

  • The use of Apple Maps within the App is subject to Apple's privacy policies, which govern the collection and use of location data, as well as the terms under which Apple provides its mapping services.

2. License Grant

  • You are granted a non-exclusive, non-transferable, revocable license to use Apple Maps solely in connection with your use of the App for navigation purposes (e.g., to get driving directions to nearby clean restrooms or to locate restroom owners on the map).

  • You may not use Apple Maps for any other purpose, including, but not limited to, redistribution, commercial use, or reverse engineering of the Maps API.

3. Restrictions on Use

  • You may not use Apple Maps for any illegal, unauthorized, or harmful purpose. This includes, but is not limited to, use for purposes that violate applicable laws, infringe on the rights of others, or involve harmful content.

  • You may not use Apple Maps to collect, store, or share personally identifiable information or any other data that violates privacy laws, except as required by the functionality of the App for its intended purpose.

4. Data Collection and Privacy

  • The App uses Apple Maps to collect location-based data necessary to provide its features (e.g., showing nearby clean restrooms and providing driving directions). This data may include your current location, which is used solely to provide these features.

  • Apple Maps collects location data as part of its operation. By using the App, you acknowledge and consent to Apple's collection of location data in accordance with Apple's Privacy Policy available at Apple Privacy PolicyURL.

5. No Warranty

  • Apple Maps is provided "as is," without warranties or representations of any kind. Apple does not guarantee the accuracy, completeness, or reliability of Apple Maps.

  • Double L Tech LLC makes no representations or warranties regarding the accuracy, functionality, or availability of Apple Maps within the App.

6. Liability Limitations

  • To the fullest extent permitted by law, Double L Tech LLC and Apple are not liable for any damages, losses, or injuries resulting from the use of Apple Maps within the App. This includes any errors, omissions, or interruptions in the mapping services.

  • You agree to indemnify and hold harmless Double L Tech LLC and Apple, as well as their affiliates, from any claims, losses, or damages arising out of your use of Apple Maps.

Important Notice

This Mapping API License is an addition to the End User License Agreement (EULA) and is required by Apple for the use of Apple Maps in your app. By using the App, you acknowledge that you have read, understood, and agree to the terms outlined above and to the terms provided in Apple’s Maps Terms of Service and Privacy Policy.
